    Why NYC’s Sweeping Student AI Ban Is Destined to Fail

    Schools across the United States have spent the past three years moving from replacing outright ChatGPT bans with guidelines for how AI in classroom use, with at least 37 states now providing schools with official AI guidance. 

    New York City has gone a step farther by implementing yet another rule. Its one-year moratorium, announced in early September, removes student-facing generative AI for nearly 600,000 students from 2-K through eighth grade, suspends about 40 classroom tools, and bans companion chatbots in all grades. But high school students still retain limited supervised access, while teachers may use AI for planning but not grading.

    However, AI remains available on personal devices and at home, creating an enforcement gap at the centre of why the ban may fail.

    Why New York Is Pulling AI Out of Classrooms

    Mayor Zohran Mamdani said children need teachers, human connection, and the chance to work through difficult problems themselves, and this concern has evidence behind it.

    In August, 70% of teenagers reportedly use AI for schoolwork. According to Common Sense Media, nearly two-thirds of those users said they had used it in ways that handed some of their thinking to the technology.

    As such, the moratorium responds to a real problem. AI can produce answers before students develop the reasoning needed to test them. 

    But it also sheds light on why a ban still doesn’t teach students how to recognise weak answers, bias, or made-up information.

    The Ban Stops at the School Gate

    The policy can control school networks, approved software, and city-issued devices. But it cannot reliably prevent a student from opening the same tools on a personal device or using them at home, which means monitoring AI use outside school remains an unresolved question.

    Common Sense Media also found that 44% of teenage AI users had encountered a blocked tool on a school network or device. Among that group, 59% simply switched to a personal device to get around the restriction.

    This points to enforcement being more complicated than blocking one chatbot. 

    While the city must disable AI features across about 40 existing education products, teachers and selected high school students still retain approved access. And these boundaries leave schools with the difficult job of deciding which automated feature counts as generative AI and whether work completed outside the classroom used it.

    New York Has Tried a Ban Before

    In January 2023, the city blocked ChatGPT on school networks and devices over concerns about learning and inaccurate content. However, the restriction could not stop students from using it on personal devices, and the city reversed the decision four months later.

    The school system then moved towards teaching responsible use and later introduced a custom AI assistant. According to reports, the earlier restriction was replaced, which offers the clearest warning for this new policy.

    A Pause Still Needs a Lasting Plan

    New York will use the moratorium to review school technology, while a task force is expected to deliver recommendations in April 2027. This work will determine whether the policy becomes more than another temporary block.

    While the ban may reduce classroom exposure during the current school year, it is still unlikely to stop students from using AI or settle how they should learn with it. And unless the review produces clear safeguards, teacher support, and age-appropriate AI literacy before high school, New York risks repeating 2023 and lifting another ban after the technology has already moved ahead.
